1. Accepting these terms
These Terms of Use apply when you access or use bargainbites.com.au. By creating an account, submitting a deal or confirming a listing, you agree to these terms. If you do not agree, you may still browse the public website but must not use account or contribution features.
Bargain Bites is operated in Sydney, New South Wales, Australia. Questions about these terms can be sent to hello@bargainbites.com.au.
2. Eligibility and accounts
You must be at least 16 years old to create an account or contribute. You must provide accurate account information, use an email address you are entitled to use and keep access to your email account secure. You are responsible for activity carried out through your account.
Contact us promptly if you believe your account has been accessed without permission. We may restrict or close accounts that breach these terms or present a security, fraud or community-safety risk.
3. Community deal information
Bargain Bites is a community information service. Unless clearly stated otherwise, listings are submitted or confirmed by users and are not advertisements issued or verified by the relevant venue.
Prices, inclusions, hours and availability can change or be entered incorrectly. Before travelling or purchasing, check important information directly with the venue. Always ask the venue about ingredients, allergens and dietary requirements; Bargain Bites does not provide food-safety, allergy or medical advice.
4. Rules for contributions
When submitting or confirming a deal, you must act honestly and have reasonable grounds for believing the information is current and accurate. You must not submit:
- false, misleading, fabricated, expired or duplicate listings;
- content copied from another source unless you have permission to use it;
- personal information, confidential information or images of people without permission;
- spam, scams, undisclosed paid promotions or manipulated confirmations;
- offensive, discriminatory, defamatory, threatening or unlawful material; or
- malware, automated submissions or anything intended to interfere with the service.
If you are connected to a venue or receive a benefit for a submission, you must clearly disclose that relationship.
5. Permission to use contributions
You keep ownership of content you create. When you submit content, you give Bargain Bites a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, edit for clarity, publish and display it for operating, promoting and improving Bargain Bites. This licence continues for as long as the content remains on the service.
You confirm that you have the rights needed to submit the content and grant this licence.
6. Moderation and removal
We may review, edit, reject, hide or remove any listing or contribution, including content we believe is inaccurate, stale, unlawful, promotional or inconsistent with these terms. We are not obliged to pre-screen every contribution and cannot guarantee that every issue will be detected.
To report a listing, infringement or other concern, email hello@bargainbites.com.au with the listing details and reason for the report.
7. Points and future rewards
Points are a community participation feature. They are not money, property, stored value or a promise of any reward, and they cannot be sold, transferred or redeemed for cash. We may correct points awarded through error or misuse and may change or discontinue the points system on reasonable notice.
Any future promotion, competition, partner benefit or redeemable reward may have separate eligibility rules and terms.
8. Third-party services and venues
Links to maps, venue websites and other third-party services are provided for convenience. Those services have their own terms and privacy practices. Bargain Bites does not control and is not responsible for a venue’s food, service, pricing, availability or conduct, or for third-party websites and services.
A venue name or trade mark is used only to identify the subject of a listing and does not imply sponsorship, endorsement or partnership.
9. Our website and intellectual property
Except for user contributions and third-party material, Bargain Bites owns or licenses the website design, branding, software and original content. You may use the service for personal, non-commercial purposes. You must not scrape, bulk-copy, reverse engineer, resell or commercially exploit the service except as permitted by law or with our written permission.
10. Availability and changes
We may change, suspend or discontinue any part of Bargain Bites. We aim to keep the service useful and available but do not promise uninterrupted, error-free or permanently available access.
11. Liability and consumer rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.
To the maximum extent permitted by law, Bargain Bites is not liable for loss arising from reliance on an inaccurate or expired community listing, a venue’s acts or omissions, third-party services, or unauthorised account use where we did not cause or contribute to it. Where our liability can lawfully be limited, it is limited to resupplying the relevant service or paying the reasonable cost of having it resupplied.
12. Privacy
Our Privacy Policy explains how we handle personal information. It forms part of the information provided to you about using Bargain Bites but is not intended to create rights or obligations beyond applicable privacy law.
13. Governing law and changes
These terms are governed by the laws of New South Wales, Australia. You and Bargain Bites submit to the courts of New South Wales and courts entitled to hear appeals from them.
We may update these terms to reflect changes to Bargain Bites or applicable law. Material changes will apply from the updated effective date and, where appropriate, we will provide additional notice. Continuing to use account or contribution features after the changes take effect means you accept the updated terms.
